Terms And Conditions

  1. Gift Voucher Expiration

    1. The expiry date for each gift voucher purchased is clearly marked on the gift voucher email, and printed voucher - "valid for 12 months from date of purchase".

    2. Once a voucher has expired there is no refund (in whole or in part) and is no longer valid (unless extended - see below). Any attempt to redeem the voucher after the expiry date will be declined. After the expiry date the purchase price of the experience will be forfeited and remains the property of Mr Aristotle.

    3. Conditions for Extensions - for a flat fee of $30AUD the expiry date of the voucher may be extended by 3 months only if the request for the extension is received by Mr Aristotle prior to original expiry date.

    4. If required by applicable local laws of the place of the Experience Provider (such as some States in the United States of America), expiry dates do not apply for gift vouchers.

  2. Gift Voucher Loss

    1. All is not lost! The purchaser may apply for a replacement voucher provided that the following conditions are met:

      1. (a)  Voucher is still valid and has not yet been redeemed.

      2. (b)  Proof of purchase is required (order number, full name of purchaser and email address).

      3. (c)  Satisfactory evidence of the loss is provided to Mr Aristotle.

  3. Gift Voucher Refunds

    1. Gift vouchers are non refundable and not redeemable for cash except as set out below.

    2. If the Experience Provider is unable to provide the purchased experience for reasons given to the satisfaction of Mr Aristotle, a refund for the full amount of the gift voucher will be made to the purchaser. (excluding booking and processing fees which will be itemised at the time of purchase).

    3. The purchase price of gift vouchers will be refunded to the purchaser due to unforeseen circumstances such as Act of God, War, Terrorism, Insolvency of the Experience Provider, health issues that severely inhibit the Gift Voucher Recipient from fulfilling the experience. However Mr Aristotle reserves the right at its discretion to make such refund.

  4. Delivery

    1. Incorrect Email Address - please make sure you get this correct! It is the responsibility of the purchaser to enter all required information and email address details correctly. Mr Aristotle will not be responsible for missing or delayed vouchers due to incorrect email address/information details.

    2. Upon proof of purchase for a missing voucher due to incorrect details, a replacement voucher will be sent but subject to Gift Voucher Loss requirements. Booking and processing fees will apply for a replacement voucher if issued.

  5. Purchasing

    1. Before final payment occurs, it is the responsibility of the purchaser to agree and accept the terms and conditions of purchasing a voucher with Mr Aristotle.

    2. The purchaser will not be able to proceed with the gift voucher purchase without accepting the terms and conditions.

    4. Credit Card charges through the payment gateway Paypal will be made in the currency as indicated on the website. Exchange rates for foreign currency payments to overseas Experience Providers will be charged accordingly at the time of purchase.

    5. A booking and processing fee will apply to each gift voucher purchased and will be in the same currency as the experience being purchased. This will be a flat fee of $7AUD or €5EUR or $7USD or £5GBP. Any other currencies as may be required will be negotiated at the time of purchase but will generally be in accordance with officially declared rates of exchange.

    6. As the purchaser you can choose to have the Gift Voucher sent to you for printing or sent to yourself and the recipient concurrently via printable email (outlined at point of purchase). 

    7. The purchase price of the voucher will be held in a trust account until either the experience is redeemed or refunded or forfeited as set out in these terms and conditions.

  6. Booking with the Experience Provider

    1. Using your Gift Voucher - this is the only work the recipient has to do! Responsibility lies completely with the Gift Voucher Recipient. It is the Gift Voucher Recipient's responsibility to contact the Experience Provider using the details provided at redemption of the voucher through the Mr Aristotle website.

    2. Each voucher contains a unique code which is to be used to redeem. Visit mraristotle.com and click on 'redeem voucher.' Inputting the unique voucher code will release the contact details required to book in your experience.

    3. Cancellations - Gift Voucher Recipient must comply with the cancellation policies of the Experience Provider. If the Gift Voucher Recipient does not comply with such cancellation policies then the Gift Voucher Recipient may lose the entirety of the voucher/experience.

    4. Some cancellations may occur (ie weather conditions) where the Gift Voucher Recipient will be notified as soon as possible by the Experience Provider giving the Gift Voucher Recipient ample time to re-book an alternate date.

    5. Mr Aristotle will not be responsible for any charges directly or indirectly incurred due to any cancellation or deferral in redeeming the voucher.

  7. Safety of Experience

    1. It is the responsibility of the Experience Provider to have in place the necessary safety requirements and insurance for the experience.

    2. All restrictions and special conditions (including in some specialised circumstances personal injury insurances) for the experience are outlined on the Mr Aristotle website during the purchase.

    3. It is the responsibility of the purchaser of the voucher to read and agree to all conditions and restrictions before proceeding with the purchase of the voucher.

    4. It is also the responsibility of the Gift Voucher Recipient to read and agree to the terms and conditions when redeeming the voucher. The Gift Voucher Recipient must accept all terms and conditions before details of the experience provider will be released.

    5. Experience Providers are responsible for maintaining the appropriate liability insurances associated with their experience (except where specifically excluded). Upon gift voucher redemption, responsibility rests with the Gift Voucher Recipient to enquire about necessary insurance and agreement to the Experience Provider's full terms and conditions.

  8. Updating of Pricing Information

    1. Price information will be updated from time to time with each Experience Provider.

    2. Prices will be displayed on the Mr Aristotle website in the local currency to the experience location or the currency as chosen by the Experience Provider.

    3. Any relevant tax or charge for the location/country of the experience will be displayed on the Mr Aristotle website, if known during the gift voucher purchase (but in any event will be the responsibility of the purchaser/gift voucher recipient).

  9. Gift Voucher Transfer

    1. Each gift voucher is fully transferrable by the purchaser of it to the Gift Voucher Recipient as long as the voucher has not yet been redeemed and is still prior to the expiry date.

  10. Warranty/Indemnity

    1. Experience Provider warrants that:

      1. it is a commercial (as opposed to a consumer) entity; and

      2. if any change affecting the Experience Provider (or its operations) could have an effect on the operation of this Agreement, the Experience Provider will inform Mr. Aristotle in writing of that change immediately.

    2. Mr. Aristotle warrants that it will undertake its obligations with reasonable skill and care.

    3. The Experience Provider shall indemnify and hold harmless Mr. Aristotle (and its directors, officers, agents, representatives and employees) from and against any and all claims, suits, liabilities, judgements, losses and damages arising out of or in connection with any claim or suit or demand:

      1. by a Gift Voucher Recipient (or any party on whose behalf a Gift Voucher Recipient has been acting);

      2. in respect of, arising out of, or in connection with, Voucher Services (or any other goods or services actually or purportedly offered in respect of or connected to a Voucher);

      3. in respect of, arising out of, or in connection with a Voucher;

      4. in respect of or connected to the collection or payment of GST (or any imposition of any tax or government charge) in any way connected to this Agreement or any matter or goods or services under or arising from it (e.g. Voucher Services).

  11. Legals

    1. Entire Agreement: This Agreement contains all the terms agreed between the parties regarding its subject matter and supersedes and excludes any prior agreement, understanding or arrangement between the parties, whether oral or in writing. No representation, undertaking or promise shall be taken to have been given or be implied from anything said or written in negotiations between the parties prior to this Agreement except as expressly stated in this Agreement. Neither party shall have any remedy in respect of any untrue statement made by the other party upon which that party relied in entering into this Agreement (unless such untrue statement was made fraudulently) and the party's only remedies shall be for breach of contract as provided in this Agreement. This Agreement is to the exclusion of all other terms and conditions submitted, proposed or stipulated by the Experience Provider (including any terms or conditions which the Experience Provider purports to apply under any purchase order, confirmation of order, specification or other document) and no terms or conditions endorsed upon, delivered with or contained in the Experience Provider's purchase order, confirmation of order, specification or other document will form part of this Agreement.

    2.  

      1. Preservation of rights: No waiver by Mr. Aristotle of any violation or default in performance of the provisions of this Agreement shall be deemed a waiver of such provisions of the right of Mr. Aristotle to thereafter enforce such provisions or any other provisions of this Agreement.

      2. Severing anything invalid in this Agreement: The invalidity or unenforceability of any term of or right arising pursuant to this Agreement shall not adversely affect the validity or enforceability of the remaining terms and rights.

      3. No third party rights: No term of this Agreement shall be enforceable by a third party.

      4. No assigning this Agreement: the Experience Provider may not assign, transfer, charge or otherwise encumber, create any trust over or deal in any manner with this Agreement or any right, benefit or interest under it nor transfer, novate or sub-contract any of the Experience Provider's obligations under it.

    3. Liability: Mr. Aristotle does not exclude or limit Liability for any Liability that cannot be excluded by law. Subject to the preceding sentence, Mr. Aristotle shall not be under any Liability for:

      1. loss of actual or anticipated profits;

      2. loss of goodwill;

      3. loss of business;

      4. loss of revenue or of the use of money;

      5. loss of contracts;

      6. loss of anticipated savings;

      7. loss of data and/or undertaking the restoration of data; or

      8. loss or damages for personal and/or property injury occurring through or out of the experience;

      9. any act, omission or default, whether negligent or otherwise of any EP or third party

      10. any special, indirect or consequential loss; and such liability is excluded whether it is foreseeable, known, foreseen or otherwise. For the avoidance of any doubt, clauses (a) to (i) above apply whether such damage or loss is direct, indirect, consequential or otherwise. ("Liability" means liability in or for breach of contract, negligence, misrepresentation, tortious claim, restitution or any other cause of action whatsoever relating to or arising under or in connection with this Agreement, including liability expressly provided for under this Agreement or arising by reason of the invalidity or unenforceability of any term of this Agreement.)

    4. Interpretation: The headings to and within Clauses of this Agreement are for convenience and reference only and do not form a part of this Agreement and shall not in any way affect the interpretation of this Agreement.

    5. Definitions: In this Agreement:

      1. "Agreement" means the pages of this Agreement document;

      2. "Day" means a period of 24 consecutive hours; and

      3. "Month" means a calendar month

    6. Use of contact details

      1. Contact details required include name and email address which are used to contact the purchaser if any purchasing problems occur.

      2. Financial information will be requested to complete the purchase through our online checkout system - Paypal. Paypal is a secure payment gateway. Mr Aristotle does not retain any credit card details or financial information and complies with all privacy laws requirements.

    7. vii. Details of the Experience

      1. All information, experience descriptions and details as shown on the Mr Aristotle website is provided by the Experience Provider and as such responsibility is that of the Experience Provider if any such detail is different.

    8. Restrictions

      1. Any restriction that applies to the experience (as provided by the Experience Provider) is outlined on the Mr Aristotle website. The purchaser cannot proceed to the checkout without having accepted the "I agree to the terms and conditions box" - all responsibility remains with the purchaser.

      2. At the point of gift voucher redemption, the details of the Experience Provider for redeeming the voucher will not be released to the Gift Voucher Recipient without the recipient having accepted the terms and conditions.

      3. Where specifically noted on the experience description on the Mr Aristotle website, you will be required to provide and/or be responsible for your own personal and property insurance.

    9. Acknowledgement

      1. The purchaser agrees and acknowledges that insofar as certain terms herein apply between Mr. Aristotle and the Experience Provider such terms are included herein as a disclosure to the purchaser of those conditions and the purchaser accepts the same.
